1. Introduction
This Acceptable Use Policy (“AUP”) governs your use of PropHawk services provided by Texas PropHawk DBA PropHawk (“we,” “our,” or “us”). This AUP is incorporated by reference into our Terms of Service and applies to all users of the Service.
By using PropHawk, you agree to comply with this AUP. Violations may result in suspension or termination of your account without refund.
2. Prohibited Activities
2.1 Illegal Activities
You may not use PropHawk to:
- Violate any applicable federal, Texas state, or local law or regulation
- Engage in fraud, false advertising, or deceptive business practices
- Submit false or fabricated contractor credentials or licensing information
- Impersonate another contractor, business, or individual
- Engage in identity theft, stalking, harassment, or threats
2.2 Fraudulent Contractor Practices
PropHawk is a tool for legitimate, licensed Texas contractors. You may not use PropHawk to:
- Generate proposals for contracting work in trades you are not licensed or qualified to perform under Texas law
- Create fraudulent, deceptive, or intentionally misleading proposals
- Fabricate pricing, materials, warranties, or scope of work
- Engage in bid manipulation, bid rigging, or any form of anti-competitive conduct
- Submit proposals on behalf of unlicensed entities where a license is required by the Texas Department of Licensing and Regulation (TDLR) or other applicable Texas licensing body
2.3 System and Service Abuse
- Attempting to gain unauthorized access to PropHawk or its underlying systems
- Reverse engineering, decompiling, or disassembling any part of the Service
- Using automated scripts, bots, or scrapers to access the Service without authorization
- Exceeding reasonable API or proposal generation usage in a manner that degrades Service performance for other users
- Attempting to bypass usage limits, subscription restrictions, or free trial limitations
- Creating multiple accounts to abuse free trial access
2.4 Account Abuse
- Sharing your PropHawk account credentials with unauthorized parties
- Reselling, sublicensing, or white-labeling PropHawk output or features without our express written authorization
- Using a single subscription account for multiple distinct business entities
2.5 Harmful or Illegal Content
You may not create, submit, or transmit through PropHawk any content that:
- Contains malware, viruses, or malicious code
- Promotes violence, illegal activity, or harm to individuals
- Constitutes hate speech, discrimination, or harassment
- Infringes the copyright, trademark, or other intellectual property rights of any third party
- Violates any applicable TDLR regulation, Texas Property Code requirement, or other applicable Texas law
2.6 Restricted Use Cases
PropHawk is designed exclusively for legitimate contractor proposal generation. It may not be used for:
- Non-contracting or non-trade business proposals
- Any purpose that would require PropHawk to generate content constituting the unlicensed practice of law, architecture, engineering, or any other licensed profession under Texas law
- Generating proposals for work that requires permits, inspections, or code compliance reviews that you are not authorized to perform
3. Responsible Use Requirements
3.1 Professional Conduct
You are expected to:
- Use PropHawk responsibly and professionally
- Provide accurate project information to generate accurate proposals
- Review and verify all AI-generated proposal content before delivering it to clients
- Honor commitments made in proposals submitted to clients
- Comply with all applicable Texas consumer protection and contractor laws
3.2 Licensing Compliance
PropHawk does not verify your licensing status. You are solely responsible for maintaining all licenses, bonds, registrations, and insurance required under Texas law for any trade in which you operate, including but not limited to TDLR requirements for HVAC, electrical, plumbing, and other regulated trades.
3.3 Content Responsibility
You are solely responsible for the content of all proposals you generate and distribute. Ensure all pricing, scope, material specifications, and warranty representations are accurate and not misleading to your clients.
4. Enforcement
4.1 Monitoring
We reserve the right to monitor use of the Service for compliance with this AUP, investigate suspected violations, and cooperate with law enforcement or legal authorities as required by law.
4.2 Consequences of Violations
If you violate this AUP, we may at our sole discretion:
- Issue a formal warning for first-time or minor violations
- Temporarily suspend your account pending investigation
- Permanently terminate your account without refund
- Pursue legal remedies for serious violations
- Report illegal activity to appropriate law enforcement or regulatory bodies, including TDLR
4.3 Appeals
If you believe your account was suspended or terminated in error, contact support@texasprophawk.com within 10 business days. We will review your appeal within 5–10 business days. Our decision on appeals is final.
5. Reporting Violations
If you become aware of any violation of this AUP by another user, please report it to support@texasprophawk.com with the subject line “AUP Violation Report.” Include a description of the violation and any supporting evidence. We take all reports seriously and will investigate promptly.
6. DMCA Compliance
We comply with the Digital Millennium Copyright Act (DMCA). If you believe content on or generated through PropHawk infringes your copyright, contact us at support@texasprophawk.com with: (1) identification of the copyrighted work; (2) location of the infringing content; (3) your contact information; (4) a good faith statement that the use is unauthorized; and (5) your physical or electronic signature.
7. Third-Party Compliance
Use of PropHawk also requires compliance with the acceptable use policies of our third-party providers, including Anthropic's Usage Policies and Stripe's Restricted Businesses list. PropHawk may not be used in any manner that would violate those policies.
8. Indemnification
You agree to indemnify and hold harmless Texas PropHawk, PropHawk, and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your violation of this AUP, your violation of any law or regulation, your violation of third-party rights, or content you create or distribute using the Service.
9. Changes to This Policy
We may update this AUP from time to time. Material changes will be posted on the Service with an updated “Last Updated” date. Continued use of the Service constitutes acceptance of the updated AUP.
