Important Notice
All PropHawk subscriptions are non-refundable. Please read this policy carefully before subscribing.
1. No Refunds Policy
IMPORTANT: All subscriptions to PropHawk are non-refundable. When you purchase a subscription or your free trial converts to a paid subscription, you acknowledge and agree that all fees are final and non-refundable.
Texas PropHawk DBA PropHawk operates on a subscription-based model with recurring billing. Due to the nature of digital AI services and the immediate access granted upon subscription, we do not offer refunds, credits, or prorated billing for:
- Monthly subscription fees
- Unused portions of your subscription period
- Cancellations made mid-billing cycle
- Dissatisfaction with AI-generated proposal content
- Changes in business needs or trade activity
- Technical difficulties caused by user error or incompatible browser/device
2. Subscription Details
2.1 Free Trial
New subscribers receive a 3-day free trial. You will not be charged during the trial period. You may cancel at any time during the trial to avoid being charged. Once the trial period ends, your subscription converts to a paid monthly subscription at $39/month. Canceling after the trial ends and billing occurs does not entitle you to a refund.
2.2 Monthly Subscriptions
Monthly subscriptions are billed every 30 days from your subscription start date. Each payment grants you access to PropHawk for the following billing period. All monthly fees are final and non-refundable.
3. Cancellation Policy
You may cancel your subscription at any time through your account settings or by contacting support@texasprophawk.com. Cancellation does not entitle you to a refund.
3.1 How to Cancel
- Log in to your PropHawk account at texasprophawk.com
- Navigate to Account Settings → Subscription
- Select “Cancel Subscription” and confirm
- Alternatively, email support@texasprophawk.com with your cancellation request
3.2 Access After Cancellation
When you cancel, you retain full access to PropHawk until the end of your current paid billing period. You will not be charged again. After your billing period expires, access to paid features will be discontinued.
4. Failed Payments
If your payment method fails, we will notify you by email and may attempt the charge again. You will have a grace period to update your payment method. If payment is not received within the grace period, your account may be suspended. No refund or credit will be issued for periods of account suspension due to failed payment.
5. Service Availability
PropHawk strives for continuous availability but does not guarantee 100% uptime. Scheduled maintenance, third-party API outages (Anthropic, Stripe, Clerk, Neon), or other technical interruptions may temporarily limit access. No refunds or credits will be issued for service interruptions, downtime, or degraded performance.
6. Account Termination for Violations
If your account is terminated due to violations of our Terms of Service or Acceptable Use Policy, no refund will be issued regardless of how much time remains in your billing period.
7. Chargebacks and Payment Disputes
Initiating a chargeback or payment dispute with your financial institution without first contacting us is a violation of our Terms of Service and may result in immediate account termination. If you believe there is a billing error, please contact us first at support@texasprophawk.com. We will work with you in good faith to resolve any legitimate billing concern. We will contest fraudulent or unwarranted chargebacks and provide documentation to your financial institution. You may be responsible for chargeback fees.
8. Exceptional Circumstances
In rare cases, we may issue a refund or credit at our sole discretion for provable system errors resulting in a duplicate charge, or charges made after cancellation due to our system error. To request consideration, contact support@texasprophawk.com with documentation. Approval is not guaranteed and is entirely at our discretion. This is the only scenario in which refunds may be issued.
9. Price Changes
We may change our subscription pricing at any time. Price changes will not affect your current billing period. You will be notified before new pricing takes effect at your next renewal.
